Response to Outstanding Tax Department

To file a response to the income tax department regarding the outstanding tax demand notice, here are the steps you need to follow.

You can receive an income tax notice if the tax department finds a discrepancy in the amount you paid and the income tax calculated. Your Income Tax Return (ITR) will be verified once you submit it. The tax collection department cross-checks the information about the income declared and the tax paid by you available with them. If the income tax department finds a problem with the tax you paid, then they will send you a demand notice.

How to file a response to outstanding tax demand :

Step 1: First, you have to logon to www.incometaxindiaefiling.gov.in with your User ID, Password and Date of Birth/ Incorporation
Step 2: Go to e-File and then Response to Outstanding Tax Demand.
Step 3:Below details would be displayed.
1.Assessment year.
2.Section code.
3.DIN.
4.Upload file.
5.Outstanding demand A/c.
Step 4: Taxpayer must click on the "Submit" link under the Response column for the respective AY in order to submit the response.
Step 5: If the taxpayer selects "Demand is correct", then a pop up is displayed as "If you confirm "Demand is correct' then you cannot 'Disagree with the demand'. Click on "Submit". A success message is displayed.
Step 6: If the taxpayer selects "Demand is partially correct", then "Amount which is correct" and "Amount which is incorrect" has to enter.
Step 7:If taxpayer has provided 'amount which is incorrect' then he should mandatorily fill one or more reasons for stating so as listed below:
  • Demand has been already Paid –
    1. Demand paid and Challan has CIN
    2. Demand paid and Challan has no CIN
  • Demand has already been reduced by rectification/revision
  • Demand has already been reduced by Appellate Order but appeal effect has to be given by Department
  • The appeal has been filed and
    1. Stay petition has been filed with
    2. Stay has been granted by
    3. The installment has been granted by
  • Rectification / Revised Return has been filed at CPC.
  • Rectification has been filed with Assessing Officer
